1. Who we are and what these terms cover
Hypno is a subscription wellness application offering AI-composed self-hypnosis sessions, guided meditations, breathing exercises, ambient sound, and related coaching tools. These Terms of Service govern your access to and use of Hypno's websites and applications (the "Service"). By creating an account or using the Service you agree to these terms. If you do not agree, do not use the Service.
2. Hypno is not medical care
The Service is a relaxation, focus, and mental-rehearsal practice. It is not medicine, psychotherapy, or psychiatric care, it does not diagnose or treat any condition, and it is not a substitute for advice from a licensed professional. If you experience a mental health crisis, thoughts of self-harm, or symptoms of a medical or psychiatric condition, contact a qualified professional or your local emergency services.
Never use sessions, breathing exercises, or soundscapes while driving, operating machinery, standing, or in or near water. Vigorous breathing styles carry their own on-screen cautions; follow them.
3. Eligibility and accounts
You must be at least 18 years old to use the Service. Accounts are secured with passkeys tied to your devices; you are responsible for keeping your devices and their unlock methods secure, and for everything that happens under your account. Provide an accurate email address; it is how we reach you about your account and membership.
4. Trial, membership, and billing
New accounts receive a seven-day free trial that includes a fixed allowance of generated audio. No payment method is required for the trial. After the trial, continued use of generation features requires a paid membership, billed monthly or yearly and renewing automatically until cancelled. You can cancel anytime from your account page; cancellation takes effect at the end of the current billing period. Payments are processed by our payment provider (Stripe); we do not store your card details.
Prices may change; if they do for an existing membership, we will give you notice before the change applies to you. Where required by law you may have additional cancellation or refund rights, which these terms do not limit.
5. Generated audio and minutes
Memberships include a monthly allowance of narrated audio, measured in minutes of newly generated speech. Replaying audio you have already generated does not consume minutes. Allowances exist to keep the Service sustainable; we may take reasonable steps to prevent abuse, automation, or resale of generation capacity.
6. Your own API key
Some features let you supply your own Anthropic API key. That key is stored only in your browser, is sent with your requests, and is never stored on our servers. Your use of it is governed by your agreement with Anthropic, and any charges it incurs are yours.
7. Your content and our license to you
You own what you tell Hypno: your goals, your conversations, your mindset map. You grant us the limited rights needed to process that content to operate the Service, including generating session scripts and audio for you. Generated sessions and audio are licensed to you for personal, non-commercial use. Do not resell, redistribute, or publicly perform generated audio.
8. Acceptable use
Do not misuse the Service: no unlawful use, no attempts to break, probe, or overload our systems, no reverse engineering except where the law permits it, no scraping or automated account creation, and no sharing one account across people beyond the seats your plan includes.
9. Family and team plans
Plan owners manage seats and invitations. Each member's account, mindset map, and practice history remain private to that member; owners can see seat membership, not member content.
10. Disclaimers
The Service is provided "as is" and "as available." We do not promise particular results from any practice, and we do not warrant that the Service will be uninterrupted or error-free. Wellness outcomes vary from person to person.
11. Limitation of liability
To the maximum extent permitted by law, Hypno and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
12. Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these terms or create risk for the Service or other users; where reasonable we will warn you first.
13. Changes to these terms
We may update these terms as the Service evolves. For material changes we will give notice, such as by email or an in-app notice, before they take effect. Continuing to use the Service after changes take effect means you accept them.
14. Governing law and contact
These terms are governed by the laws of the jurisdiction in which the operator of Hypno is established, without regard to conflict-of-law rules, and disputes belong to the courts of that jurisdiction unless mandatory law says otherwise. Questions about these terms: support@hypno.chat.
